The attorneys representing Dive One have negotiated a settlement in the SPENCER, SEROLYN VS CAVE DIVING SECTION OF THE NATIONAL SPELEOLOGICAL SOCIETY which also included the NSSCDS.
There is a confidentiality agreement in place. I can say that the case has been amicably resolved in the best interests of all parties concerned. To further clarify, Dive Ones attorneys negotiated a settlement which included the NSSCDS. They paid the settlement, NOT the NSSCDS. The terms of the settlement THEY negotiated require confidentiality. The NSSCDS reaped the benefit of Dive One having insurance. Disclosure of details (which we do not have anyway) would violate the terms and negate the settlement agreement as it applies to the NSSCDS. A board member speculating on any possible details of this matter could conceivably jeopardize our position and we are not willing to take that risk. Therefore, we have purposely NOT asked our attorney what the settlement is because its terms do not directly affect the NSSCDS.
The NSSCDS Board of Directors would like to thank the membership for its support and understanding concerning this matter. We would also like to thank our attorney, John Guyton, for the way he handled our case. This is not our “first rodeo” and I can say unequivically that John was fair, honest and forthright in his dealings with the NSSCDS. Thank you John for your integrity and your professionalism.
